Agreement between User and NATUREWORKS LANDSCAPE SERVICES, INC.

We are NATUREWORKS LANDSCAPE SERVICES, INC. (“Company”, “we”, “us” or “our”), a limited liability company registered in Massachusetts and headquartered at 1660 Main St, Walpole, MA 02081.

We operate the website www.yourcompany.com (the “Website”) as well as any other related products and services that are referred or linked to these legal terms (the “Legal Terms”) (collectively, the “Services”).

The Website is comprised of various web pages operated by the Company and is offered to you conditioned on your acceptance without modification of the terms, conditions and notices contained herein (these “Terms”). Indemnification

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms, whether in contract, tort or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single, neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration services mutually selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms, the prevailing party shall be entitled to recover its costs and reasonable attorneys’ fees. The parties agree to arbitrate all disputes and claims in regards to these Terms or any disputes arising as a result of these Terms, whether directly or indirectly, including tort claims that are the result of these Terms. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms.

Class Action Waiver

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class representative collection actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and the Company agree in writing otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over the form of a representative or class proceeding.

Termination/Access Restriction

The Regency at Prospect Condominium Association Inc.The Regency at Prospect depends on Hoffman Landscapes for our Winter Snow Removal. Our community is a large condominium complex of 366 homes with driveways, a large clubhouse and parking lot, sidewalks and seven miles of roads. Hoffman and their crew are diligent and courteous. They do a great job of clearing the roads, driveways, and sidewalks. Regardless of the amount of snow they clear the entire complex every time. They come back and check for returning ice after a storm and in the spring repair any damaged Belgium blocks, grass areas etc.Regency utilizes many service providers year-round and Mike Hoffman and his team are one provider that we never worry about and never have to check on for their quality of work.

Last fall I called Hoffman to discuss building a vegetable garden and refreshing some of the landscaping at my new home. One of their designers, Rick King, came out and spent over an hour walking the property with me and discussing my vision, budget, and time frame. His expertise was immediately apparent and his laid back demeanor put me at ease. He taught me a lot about the plantings on my property and how to care for them myself. Within a week I had comprehensive proposals broken out by bed for my entire property so I could easily pick and choose what I wanted to do and when. Rick even came back out to review the proposals in person and show my wife and I pictures of the plantings he had selected.I reconnected with Rick in March and they just installed a beautiful and functional vegetable garden which we are very pleased with. The crew got it installed in a day and a half and were a pleasure to work with. Darrick, the foreman, was onsite multiple times each day and extremely communicative. The guys doing the work were warm and friendly and tolerated my 4 year old helping them truck soil and mulch down with his toy wheel barrow. I even caught them cleaning up and organizing his toys as they packed up their gear at the end of the day.I’m very happy I chose Hoffman and have no problem recommending them, I look forward to working with them again soon.

Without my ever asking for it, I regularly find a “property check” email that is extremely helpful and comforting when I am away. Hired them for a large scale project and smaller scale landscaping project – all the guys were professional and efficient. They have a terrific “eye” and design skills.
